Très souvent, le logiciel libre est un objet juridiquement mal identifié, et à ce titre, il est souvent considéré comme inadapté au droit français (Linsolas, 2003). Cependant, nous consacrerons une réflexion profonde à la définition de différents types de logiciels libres.
