establishedstandardsofidentity,whichmayspecifycompositionalcharacteristicsand/ormanufacturingparametersfortheproduct,forexamplethoseformilk,yogurt,cheeses,andicecream(21CFR131.110,131.200,133,and135.110,respectively).Productsforwhichnostandardofidentityhasbeenestablishedmaybeplacedonthemarketunderanapt“commonorusualname”solongasthatnameisnotconfusingly2 similartothenameofanotherfoodanditmustdescribethebasicnatureofthefood ;however,ifthenameislikelytocauseconfusion,theproductismisbranded,withinthemeaningofsection403(g)oftheFederalFood,Drug,andCosmeticAct.Forexample,aproductismisbrandediftheproductnameincludesastandardizedfoodname,e.g.,“milk”,aspartofanameforthatproduct,e.g.,“soymilk.”TheFDAhassoruledonanumberofoccasions,issuingwarningletterstoseveralmanufacturerswhohave3 misbrandedfoodsbymisusingnamesofstandardizeddairyproducts .Addingthenameofaplantmaterialinfrontoftheword“milk”doesnotresultinanappropriatenamefornondairyproducts,astheseproductsdonotcontainmilkormilkingredients,theplantbasedliquidsarenotpermittedingredientsinmilk,nordotheyrepresentthecommonorusualnamesofthesebeverages.NMPFhasaddressedthecategoryofplantbasedimitationdairyproductsthataremarketedusingthenamesofstandardizeddairyproducts(e.g.,soymilk,riceyogurt,etc.)fromaregulatorystandpointinpreviouscommunicationswithFDAandhasillustratedthelackofcomplianceofthesemisbrandednondairyproductswiththestandardsofidentityfortheproductsthey4 attempttoimitate .Standardsofidentityweredesignedtomaintaintheintegrityoffoodproducts,toensurethatfoodsmeettheexpectationsoftheconsumer,andtopromotehonestyinthemarketplace.ThelackofenforcementbyFDAofthelongstandinglabelingprovisionsofvariousstandardsofidentityformilkanddairyproductsandotherpertinentfederal

15 packageswhenmakingfoodpurchases .Manyconsumersrelyonvisualcuesfromthefrontofthepackage(theproductimagery,styleofpackaging,nutrientclaims)andthenameofthefoodtomakeinferencesaboutthenutrientcontentoftheproduct.Giventheirphysicalstate,similarpackaging,imagesonthelabel,recommendeduses,labelclaims(e.g.“asmuchcalciumasmilk”),alongwiththeinclusionoftheterm“milk”inthenameoftheproductonthePDP,consumersarebeingmisledintothinkingtheseimitationbeveragesarenutritionallyequivalenttodairymilk.Thisconsumerassumptionwasrecentlyacknowledgedbythe2010DietaryGuidelinesAdvisoryCommitteeintheirdiscussionofnondairycalciumsources:“Alotofthethings,likesoymilkandricemilkandthealternatives,don’thavethesamenutrientcomposition(asmilk).So,makesurepeople16 understandthat.”Therefore,astheeffectofnutritionsymbolsandschemesonfoodpackagesisevaluated,NMPFremindsFDAthatthenameofthefoodalsohasanimpactonconsumers’perceptionofthenutritionalvalueofaproduct.Capitalizingonthedairyhaloofgoodhealthbypairingastandardizeddairytermlike“milk”or“yogurt”,whichconsumersexpecttocontributespecificessentialnutrientstothedietwithnutritionallyinferior,nonstandardized,formulatedplantbasedfoodsisdefraudingtheconsumerbymisrepresentingthetruenutrientcontentoftheseimitationproducts.Thenamesofnondairyalternativesmustreflectcurrentregulationsandstandardsofidentity,andshouldnotmisleadconsumersastothetruenutrientvalueoftheproduct.NMPFagainrequeststheFDAtosignificantlyincreaseenforcementeffortstopreventthemisbrandingofcertainfooditemsthatareimitationsofstandardizeddairyproducts.PleasecontactNMPFifyouwouldlikeanyadditionalinformation.Sincerely,BethPankoBriczinski,Ph.D.Director,DairyFoods&Nutrition
