Objections - Within six months of the publication of the list, authors and publishers can object to the inclusion of their books in the collective management scheme. - It’s up to SOFIA, the approved CMO, to process statements. - Applicants are not required to justify their objection. - They must be able to establish: - their identity (for authors), - their status as rights holders (for heirs and successors) - or their status as “owners of rights” to hard copy publication (for publishers). schedule - If the author raises objections, he is not required to publish at a later date.

Objections

- If the author raises objections, he is not required to publish at a later date. - If the publisher raises objections, he has two years in which to publish the book (with the agreement of the author); Failing this, the book reverts to collective management.  - Each year, after 21 September :  final list will be approved.  Three months later: licences (2 types) will be offered.

Authors and publishers retain the right to withdraw from the arrangement.  
- Authors, if they consider that the new digital availability of their book might damage their honour or reputation,  - Publishers, if they undertake to enter into a contractual arrangement to re-publish the book in agreement with the author.
Licenses
At the beginning of each year:  -SOFIA→ contacts original publishers of the books, offering an exclusive ten-year renewable licence. - Publisher that takes up such a licence has three years in which to market the re-published work. - A dedicated society will be created to digitise the books funded by equity capital from publishers and a loan guaranteed by the government. - If original publishers fail to exercise priority rights within two months → non-exclusive licences may be assigned to third-party publishers/distributors for a period of five years renewable.
Quality of digitisation
 Books must:  - be digitised at a high quality (300 dpi minimum), - or presented in EPUB format including DRM; - be marketed on at least two sites - and be compatible with at least one non-proprietary format.

 Rights payments  
 They are made annually in arrears to rights holders;  - in accordance with multiple agreements with other CMOs, - after enquiries amongst publishers, - and also via direct registration on the SOFIA website.  
Illustrations
When illustrations are included in some books:  → premium will be granted to the CMOs that manage image rights.  It will be of the order of 8%.
 It will be calculated on the basis of the average proportion of images in the relevant category.
