BEFORE THE SUPREME COURT OF NEW JERSEY In the Matter of Request for Comment on Public Access to Court Records COMMENTS OF THE REPORTERS COMMITTEE FOR FREEDOM OF THE PRESS Filed March 24, 2008Introduction The Reporters Committee for Freedom of the Press submits these comments in response to the Report of the Supreme Court Special Committee on Public Access to Court Records (“the Committee”). The Report was submitted on Nov. 29, 2007 to the Supreme Court of New Jersey (“the Court”), which is considering a revision to its policies governing the public’s right to inspect and copy court records. We appreciate the opportunity to be heard on these important issues. The Reporters Committee for Freedom of the Press is a voluntary, unincorporated association of reporters and editors that works to defend the First Amendment rights and freedom of information interests of the news media. The Reporters Committee has provided representation, guidance and research in First Amendment and Freedom of Information Act litigation since 1970. We urge the Court to adopt the Committee’s recommendation to change its overall records policy to one that presumes openness. We also strongly believe that the Court should allow electronic records to be as easily accessible as paper records, and that bulk record requests should continue to be honored. Discussion A.
