Анализированная Пьером Бирнбаумом дюркхеймская концепция государства вызывает здесь несколько оговорок. С одной стороны кажется неправильным приписывать Дюркхейму некоторую « гегелевскую» концепцию государства, чтобы прояснить свою общность классовых интересов и свой отказ от функционального синдикализма. С другой стороны сравнение учений Дюркхейма и Дюгюи проводится в спорной манере : фактически имеется больше преемственности, чем разлада. Кажется невозможным, наконец, разделить оптимизм Пьера Бирнбаума в отношении современной защиты функционального синдикализма посредством административной юристпруденции.

Pierre Birnbaums Analyse des durkheimschen Begriffs des Staats ruft einige Vorbehalte hervor. Einerseits scheint es übertrieben, Durkheim irgendeine hegelianische Auffassung des Staates zu unterschieben, die seinen Korporatismus oder seine Verweigerung der Beamtengewerkschaften erklaren konnte. Andererseits wird der Vergleich der Werke von Durkheim und Duguit in fragwtirdiger Weise geführt : in Wirklichkeit liegt eher eine Kontinuität als ein Bruch vor. Schliesslich scheint es moglich Pierre Birnbaums optimistische Einstellung gegenuber dem heutigen Schutz der Beamtengewerkschaften durch die Rechtssprechung der Verwaltungsgerichte zu teilen.

El análisis que hace Pierre Birnbaum de la concepción del Estado según Durkheim suscita aquí algunas reservas. Por una parte parece exagerado atribuir a Durkheim cualquier concepción hegeliana del Estado para explicar su corporatismo y su rechazo del sindicalismo de los funcionarios. Por otra parte la comparacion de las obras de Durkheim con las de Duguit se hace de modo contestable. De hecho se nota más continuidad que interrupción. Por fin parece imposible compartir el optimismo que manifiesta Pierre Birnbaum a propósito de la protección actual del sindicalismo de los funcionarios por la jurisprudencia administrativa.

Birnbaum's analysis of the Durkheimian concept of the State gives rise to some reticence. On the one hand, saying that Durkheim had some kind of 'Hegelian' conception of the State — in order to throw light upon his 'corporatism' and his refusal of civil service unionism — seems incorrect. On the other hand, the way Durkheim's and Duguit's works are compared is questionable. There is, in fact, more continuity than rupture. Finally, sharing Birnbaum's optimism about the actual protection of civil servant unionism by administrative jurisprudence seems impossible.

L'analyse, par Pierre Birnbaum, de la conception durkheimienne de l'Etat suscite ici quelques réserves. D'une part, il semble abusif de prêter à Durkheim une quelconque conception « hégélienne » de l'Etat afin d'éclairer son corporatisme et son refus du syndicalisme des fonctionnaires. D'autre part, la comparaison des œuvres de Durkheim et de Duguit est menée de manière contestable : en fait, il y a plus continuité que rupture. Il paraît impossible, enfin, de partager l'optimisme de Pierre Birnbaum à l'égard de la protection actuelle du syndicalisme des fonctionnaires par la jurisprudence administrative.
