PURPOSE OF THIS BOOK
In a world where the digital landscape has quadrupled over the last decade, millions of people have been able to profit from business ventures. Small businesses have gone global; international suppliers are now within reach; and there is a broader customer base for various products and services.
This book is intended to help the small business owner understand copyright law as it relates to its use through an online network. Although it will not give you a specific answer about what is “allowed” and what is “not allowed,” it will give you the knowledge needed to make the best decision.
This book is for the small business owners—boutiques, hair stylist, nail artist, clothing designers, retail outlets, jewelry makers, musicians, comedians, producers, authors, models, photographers, athletic trainers, and anyone else would like to understand how to avoid copyright infringement claims or how to start a copyright infringement claim.
ILLUSTRATIONS
A. The Associated Press v. Fairley
In 2006, Associated Press photographer Mannie Garcia took the 2006 photo of President Barak Obama, which in 2008 inspired Shepard Fairley to create what most would call the photo of the 2008 campaign. Although this case was not filed in court, the two came to an agreement as Fairley used the photo without permission.
B. Mike vs. YouTube
Mike is an avid sports fan who loves the Miami Seals football team. He is so much of a fan, that each week he posts clips of the games on his YouTube channel to advertise to everyone around the world why the Miami Seals are the best team in the nation. The Super Bowl has just passed and that following Monday, Mike posts the game on his YouTube channel to show how the New York Trains missed the winning field goal. After having over 1 million views, Mike was shocked to see that the video was deleted from his account. Is this infringement?
C. Sophia vs. Instagram
Sophia has more than 20k followers on Instagram for her high fashion clothing boutique. One day, she attempts to log into her page to find that it has been deleted from Instagram. Sophia was working to create collegiate apparel for the upcoming football season. Her leggings, t-shirts, and dresses were in colors associated with several collegiate football teams. Her “school spirit” designs contained the colors of the university and also wording such as “Roll Tide,” “Go Tigers,” but did not contain mascots or logos. Is this copyright infringement?
D. Blogger vs. Owner
Betty the online blogger has been blogging for years. On her site she gets images from another social media site that she downloads and posts on her site as her own. Her blogs get a mere 150 views monthly. Betty frequently uses the work of other people in developing her blogs. She often includes the name and the link to the original author, but she stated that she does not get expressed permission to use the pictures and information. Is this infringement?
E. Maria vs. Internet Domain
Maria sells clothing as an online retailer and hosts her site with a major company. After building the website, Maria gets an email stating that her site has been taken down based on a DMCA complaint.
