تهدف هذه الدراسة إلى بيان التنظيم القانوني لعقود البناء والمقاولات في فلسطين، ومدى ملاءمته للواقع العملي، في ظل غياب تنظيم قانوني خاص لهذه العقود في مجلة الأحكام العدلية (القانون المدني المطبق في فلسطين)، حيث اكتفت المجلة بتنظيم عقود الاستصناع وعقود إجارة الآدمي، التي تختلف في جوهرها وطبيعتها عن عقود البناء والمقاولة بشكل كبير. أدرك المشرع الفلسطيني مؤخراً أهمية هذا التنظيم القانوني، وأفرد لعقود المقاولة تنظيماً قانونياً خاصاً ضمن أحكام مشروع القانون المدني الفلسطيني، الذي لم يقر حتى اللحظة بواسطة المجلس التشريعي الفلسطيني.
