People’s Forum on Human Rights and Business, Bangkok, Nov.5-7, 2013

Joint Statement:

Call for an international legally binding instrument on human rights, transnational corporations and other business enterprises

(Bangkok) - This joint statement has been endorsed by the organisations listed below, and was drafted by participants in the first annual Peoples' Forum on Human Rights and Business. The Forum was convened jointly by ESCR-Net and Forum-Asia from 5 to 7 November in Bangkok, Thailand.

We,theundersignedorganisations,

Concerned about the continuing abuses and violations of human rights occurring all over the world which directly or indirectly engage the responsibility of business enterprises;

Concerned also that such abusive conduct often disproportionately impacts women, who comprise the majority of workers in the most vulnerable sectors, peasants, indigenous peoples, persons living in poverty, children among others, and especially concerned by the fact that justice is denied to those who suffer harm,

Considering the invaluable work done by human rights defenders and organisations, trade unions, indigenous rights and women rights defenders and others defending and protecting human rights in the face of corporate- related abuses,

Concerned at the incidence of attacks, harassment, restrictions, intimidation and reprisals against these human rights defenders,

Considering the initiatives taken by some States within and outside the United Nations human rights bodies as well as the action and work undertaken by human rights experts and bodies of the United Nations to provide better protection of human rights in the context of business operations,

Recalling existing States’ obligations under global and regional human rights treaties and the need to implement and complement those treaties to make them effective in the context of business transnational operations,

Convinced of the need to enhance the international legal framework, including international remedies, applicable to State action to protect rights in the context of business operations, and mindful of the urgent need to ensure access to justice and remedy and reparations for victims of corporate human rights abuse,

1. Call upon the States to elaborate an international treaty that:

a) Affirmsthe applicability of human rights obligations to the operations of transnational corporations and other business enterprises;

b) RequiresStates Parties to monitor and regulate the operations of business enterprises under their jurisdiction, including when acting outside their national territory, with a view to prevent the occurrence of abuses of human rights in the course of those operations,

c) RequiresStates Parties to provide for legal liability for business enterprises for acts or omissions that infringe human rights; d) RequiresStates Parties to provide for access to an effective remedy by any State concerned, including access to justice for foreign victims that suffered harm from acts or omissions of a business enterprise in situations where there are bases for the States involved to exercise their territorial or extraterritorial protect- obligations. e) Providesfor an international monitoring and accountability mechanism. f) Providesfor protection of victims, whistle-blowers and human rights defenders that seek to prevent, expose or ensure accountability in cases of corporate abuse and guarantees their right to access to information relevant in this context 2. Callon the United Nations Human Rights Council to take step towards the elaboration of this treaty, and to that end establish an open ended working group tasked with a drafting mandate. 3. Callon civil society organisations to take measures towards the establishment of a joint initiative to achieve the objective of a legally binding instrument within the United Nations without delay.

Llamado a un instrumento internacional sobre derechos humanos, empresas transnacionales y otras empresas comerciales

(Bangkok) - Esta declaración conjunta ha sido respaldada por las organizaciones que se enumeran a continuación, y fue elaborada por los participantes en el primer Foro anual de los Pueblos sobre los Derechos Humanos y las Empresas. El Foro fue organizado conjuntamente por la Red-DESC y Forum-Asia del 5 al 7 de noviembre en Bangkok, Tailandia.

Las organizaciones firmants,e

Preocupados por los continuos abusos y violaciones a los derechos humanos que ocurren en todo el mundo y que directa o indirectamente involucran la responsabilidad de empresas comerciales,

Preocupados también de que dichas conductas abusivas afectan de manera frecuente y desproporcionada a mujeres, representando a la mayoría de los trabajadores en los sectores mas vulnerables, campesinos, pueblos indígenas, personas viviendo en situación de pobreza, niños, entre otros, y especialmente alarmados por el hecho de que la justicia es negada a aquellos que sufren daños,

Considerando el invaluable trabajo realizado por defensores y organizaciones de derechos humanos, sindicatos, defensores de derechos de los pueblos indígenasy de los derechos de las mujeres y otros en defensa y protección de los derechos humanos frente a aquellos abusos,

Preocupados por el incremento en los ataques, persecución, intimidación, restricciones y represión contra las defensoras y defensores de derechos humanos,

Considerando las iniciativas tomadas por algunos Estados dentro y fuera de los órganos de derechos humanos de las Naciones Unidas, así como las acciones y el trabajo realizados por expertos y órganos de derechos humanos de las Naciones Unidas para brindar una mejor protección a los derechos humanos en el contexto de operaciones de empresas,

Recordando las obligaciones existentes de los Estados en virtud de tratados internacionales y regionales de derechos humanos, y la necesidad de aplicar y complementar estos tratados para hacerlos efectivos en el contexto de operaciones de empresas trasnacionales,

Convencidos de la necesidad de fortalecer el marco jurídico internacional aplicable a la acción del Estado, incluyendo recursos y reparaciones a nivel internacional, para proteger los derechos en el contexto de operaciones empresariales, y conscientes de la urgente necesidad de asegurar el acceso a la justicia, remedios y reparación a víctimas de abusos de los derechos humanos por parte de empresas,

1. Hacen un llamado a los Estados para la elaboración de un tratado internacional que:

a) Afirmela aplicabilidad de las obligaciones de derechos humanos a las operaciones de empresas transnacionales y otras empresas comerciales,

b) Obliguea los Estados Parte a vigilary regular las operaciones de empresas y negocios bajo su jurisdicción, inclusive cuando éstas actúen fuera del territorio nacional, con el fin de prevenir las violaciones de los derechos humanos durante estas operaciones,

c) Obliguea los Estados Parte a establecer responsabilidad legal de las empresas por sus acciones u omisiones cuando estas vulneren derechos humanos,

d) Obliguea los Estados Partes a proporcionar acceso a un recurso efectivo por parte de cualquier Estado concernido, incluyendo el acceso a la justicia para las víctimas extranjeras quehan sufrido perjuicios causados por actos u omisiones de una empresa en situaciones donde los Estados involucrados tienen bases para ejercer sus obligaciones territoriales o extraterritoriales de protección,

e) Establezcaun mecanismo internacional de vigilancia y rendición de cuentas.

f) Proveerprotección para las víctimas, informantes y defensores y defensoras de derechos humanos que buscan prevenir, exponer o asegurar rendición de cuenta en casos de abusos cometidos por las empresas, así como garantizar el derecho al acceso a la información dentro de este contexto.

2. Hace un llamado al Consejo de Derechos Humanos de las Naciones Unidas a tomar las acciones conducentes a la elaboración de este tratado, y con tal propósito establezca un grupo de trabajo de composición abierta con mandato para redactar un borrador.

3. Hace un llamado a las organizaciones de la sociedad civil a tomar medidas encaminadas al establecimiento de una iniciativa conjunta para alcanzar el objetivo de contar con un instrumentovinculante en las Naciones Unidas lo antes posible
