For the reasons discussed below, the Kansas Departm ent of Health and Environm ent (“KDHE”) should deny the requested perm it. If KDHE continues to process the perm it, it must revise it substantially, and provi de public notice, and an opport unity for the public to comm ent and request a hearing on th e re vised, proposed perm it.
