This book is a non-fiction, painfully true account of an American whistle blower whose silencing was attempted by conflicted and vengeful bureaucrats. This work presents oversights within the regulatory Securities and Exchange Commission (SEC), The U.S. Justice Department, and The Bureau of Prisons penal systems (BOP); as an innocent former US Marine and 60 year old grandfather is actually placed in high security solitary confinement for trying to warn the country of the impending financial crisis (now current, admitted, acknowledged, and publicized) and how it could have been prevented. He committed no crime, was never afforded the due process of law or a proper trial, was neither indicted nor convicted of anything, but was incarcerated in solitary confinement for 83 days in an attempt to silence him, while the SEC dismantled his successful public company, which was the holder of a $700,000,000.00 judgment then being litigated against the SEC.

This entertaining and informative book presents the issues, actions and utter contempt that many governmental employees exhibit towards all citizens who rely upon them for professional and responsible representation and treatment. It skillfully exposes the reader to an annual 60 Billion dollar prison budgeted sink hole in dire need of investigation and improvement. From the Author's "Woody Allen type" humor in relaying the horrific reality of our prison systems and governmental agencies, the reader will not be able to stop turning the pages to meet the segments of society and their abhorrent, illegal and unconstitutional actions that this work exposes.

When you agreed to marry me, neither you nor I could have fully grasped the depth or extent of “for better or for worse” as it would eventually apply to our life together.
You have stood by me during what has surely been the “worse”.
You have been publicly humiliated by those who sought to get to me, through harming you. They did their best to frighten and intimidate you with threats and financial attacks. Yet, during it all you never wavered – (maybe “swayed” a bit at times - justifiably).
Thank you for gently teaching me more about love and loyalty than I was forced to learn about the vindictiveness of wounded bureaucrats. I’ll never forget the pain I felt being separated from you for so long.

FOREWORD – A National Scandal
Much has been said and written during the past year regarding who is to blame and exactly what caused this complex economic meltdown and loss of confidence in our trading and capital systems.
The public needs an understandable explanation of the truth, as well as, the confidence that those in charge will correct the past mistakes.
Following is a straightforward presentation of past and recent events that any individual can follow, understand and derive a logical conclusion from.
The past SEC administration was incompetent or conflicted. They permitted and covered up the gross abuse of established securities trading rules.
One small American company identified the problem of “naked short selling” and even went to Court to prove it existed. They won substantial jury-decided lawsuits against several investment brokerages. They then were compelled to sue the SEC administration for its failure to protect the company and its shareholders from these activities.
What was their reward for being the Whistleblowers who took on the SEC in an attempt to prevent the continuation of these violations and possibly prevent the economic meltdown of late?

When the public sees that the SEC is neither a formal nor a transparent agency of our government, their reaction will be predictable. They will demand to open the SEC’s books. Then, the cause of the current economic problem and its solution will be in the hands of the public.
Naked shorting is a significant cause of the present financial crisis, which the SEC failed to regulate for years in the interests of Wall Street firms, as well as itself. (just as it also failed to prevent the Madoff scandal)
A number of Senators have recently called for a ban on naked short selling, which, in the past, the SEC vehemently and repeatedly denied the existence of.
This failure by the SEC to regulate our trading markets for years has led to the destruction of thousands of small public companies, substantial devaluation of investments, the loss of 401Ks by millions of Americans, and the tragic loss of hundreds of thousands of jobs.
The SEC has permitted, and actively covered up this national scandal of naked shorting for more than 15 years and, as you will painfully witness in the pages of this book, it actively harassed and persecuted prominent whistleblowers to silence them in the interest of the naked short sellers, and the SEC itself.
Trillions of counterfeit and unregistered shares in the names of small public companies have been permitted by the SEC to be traded - destroying their market values and thereby contributing to many of their eventual bankruptcies.
Naked short sellers do not have to purchase the stocks they originally sold short, when the subject company fails due to the downward stock price pressure of the naked short selling of its stock, as well as the internet posting of negative propaganda on the company.
Proper taxes are not paid on the revenues the naked shorters collected through the illegal selling of these phantom non-existing shares. These unpaid taxes, it is estimated by the Wall Street Journal, would be enough to pay off the National Debt.
Naked Short Selling, selling shares you do not own and never deliver, is Grand Larceny under the laws of every State. It is also a violation of the counterfeiting Statutes of the United States.
Those who commit these crimes and those who, by their denial fail to prevent and thus perpetuate them, deserve to be imprisoned … not their victims or the whistleblowers exposing them.
 
PROLOGUE – Case Profile
Universal Express (USXP) operated as a pristine and exemplary small public company for 17 years. It was ignominiously silenced by rogue government officials in days. For the good of our future economic trading system and other vulnerable United States public companies the following facts need to be exposed and understood. We ask the interested public to simply allow these chronological facts in this profile to speak for themselves.
The present Securities and Exchange Commission and the United States Court of Claims need to address the facts that this book will present.
This case involves the failure of previous SEC administrations to stop naked short sellers and to expose SEC employees who destroyed Universal Express and permitted the destruction of thousands of other small publicly-traded companies.
Despite the ongoing efforts of Universal Express and its officers previous SEC administrations had failed for more than a decade to take any effective regulatory or enforcement action against illegal naked shorting or naked shorters themselves.
The failure to regulate and enforce naked shorting rules by previous SEC administrations bordered on criminality, cover-up and, gross fraud.
Naked short selling is selling shares one does not own, and has no intention of ever purchasing or delivering.
