debunking complaints against attorneysI often receive calls from potential clients whining about other attorneys who represent them, have signified them, or they've telephoned to represent them. Here are a few of the best call subjects, and my replies to them. Comment: "I have telephoned or e mailed many lawyers and no one but you have returned my calls or e mails." Answer: An attorney does not need to communicate with a person who's fishing around for advice that is free, and telephones 15- 20 attorneys or maybe more in the process. A brief query is fine, but some callers want to spend a lot of time discussing their situation. Lawyers typically only need information that is specific to find out if callers have a case that is workable, so please be respectful of the time along with the questions you ask of them.Bronx Workers Compensation AttorneySince it's not clear how many attorneys are contacted via one e mail a general e mail is even worse. I have had many e mails sent if you ask me via websites that are addressed to lawyers with different names. The inquirer did not really make an effort to change the name. Why really would a lawyer even respond to such an e mail? There are also many scam e mails attorneys receive from all around the globe, and it's also not easy to tell which are valid. Let us do the mathematics. They've businesses to run and expenses to match. These same callers wouldn't dream of taking up another professional's time free of charge. Comment: "My attorney did not do anything, or did not say anything in court." Answer: Although this will be the case, in my many years of experience I discover this is uncommon. Lawyers often do much of the work behind the scenes, , nor convey every single thing they do to their client, as this will be even more time-consuming, especially to clients who pay hourly, and who would not value being charged for this particular service.Bronx Workers Compensation AttorneyAttorneys also cannot guarantee the results of any case. Lawyers who appear in court have to measure the things that they say. They don't often want to raise numerous objections which may transgress the judge and delay the proceedings; they may determine from the judge's disposition or nature of the case that saying less would be better; and they may decide to play the good layer and let the opposing lawyer rant and rave to their client's detriment. Clients think that the lawyer who raves and rants is the better attorney and don't always understand these nuances. A real courtroom experience is very different from a televised courtroom encounter, although they probably get this belief from television. Opinion: "Many other attorneys have told me what you said, but I don't believe it and I want to take my chances that I can convince the judge of my case on my own." Answer: I frequently say to clients, can you perform brain surgery on yourself, and if not, why would you think you understand more about what the law states and courtroom process than the
usual attorney? Don't mistake your eligibility to file a case in court as a pro se litigant with the conviction you could represent yourself. Obviously there are some people who represent themselves successfully, but it is an extremely rare result in a complex case in a court other than a first degree court. Opinion: "It isn't reasonable, where is justice?" Reply: Life in general is not rational, and justice depends on many things. A soup to nuts suit on issues that are particular costs the very least of $75,000-$100,000 a and upwards lawyer's time the of of, plus dollars in court. If one can afford to cover that amount to a lawyer, that is fantastic.
