FOR MAKING COMMENTS ON THE OLDHAM REPLACEMENT UNITARY
DEVELOPMENT PLAN REVISED DEPOSIT OCTOBER 2003
This note provides guidance to any person or organisation wishing to make a comment on the proposed changes
contained within the Revised Deposit of the Replacement Unitary Development Plan (UDP) and briefly explains
where the Revised Deposit stage fits in to the review of the UDP.
THE UDP REVIEW
Consultation on planning issues was undertaken in Spring 2000 and comments from the public and organisations
were considered in drafting the Replacement UDP. The Council’s first draft of the Replacement UDP, known as
the “First Deposit UDP”, was published for public comment during Autumn 2001. The revision to that, known
as the “Revised Deposit UDP”, has now been placed “on deposit”, meaning that it is publicly available for people
to read and comment on, for a period of six weeks from Wednesday 22 October to 5 pm on Wednesday 3 December
2003. Any comments must be received by the end of this period.
The Revised Deposit UDP is a very important stage in the review. It offers the opportunity for people to comment
on the changes proposed by the Council to the First Deposit UDP and to withdraw their objections made to it if
the proposed changes satisfy their original objections.
HOW TO COMMENT
Anyone may formally object to, or support, proposed changes in the Revised Deposit UDP using the official
comment forms. Objectors to the First Deposit UDP whose objections have been met by the proposed changes
in the Revised Deposit UDP should use the comment forms to register their support for the appropriate proposed
change and conditionally withdraw their objection (i.e. subject to the proposed change being adopted). Please
note that comments cannot be treated as confidential.
If you made an objection to the First Deposit UDP and Oldham MBC have not proposed a change in the Revised
Deposit UDP that relates to your objection you do not have to complete a comment form. Your original objection
will still be valid and will be considered by the independent Inspector at the Public Local Inquiry. You will be
contacted in due course prior to the Inquiry with details.
It is IMPORTANT to emphasise that the Council is unable to accept comments on those parts of the Revised
Deposit UDP that are unchanged from the First Deposit UDP, or on omissions from the Plan.
HOW TO COMPLETE THE COMMENT FORM
Please use a separate comment form for each proposed change that you wish to object to, or support. Please
use black or dark ink and write clearly. The following notes provide guidance on how to complete the form.
Unique Reference Number
Each representation to the First Deposit UDP was given a Unique Reference Number i.e. each separate objection
or support made was given a Unique Reference Number. These have been provided to objectors and supporters
in previous correspondence from the Council. (An example of a nine-digit Unique Reference Number would be
0915/1/001/0.)
Question 2 If you are using an agent, all correspondence will be sent to the agent’s address.
Note 3 (Question 3) If you previously objected to the First Deposit UDP but now wish to unconditionally
withdraw your objection, e.g. because you have moved out of the area, please provide details about the objection,
including the appropriate Unique Reference Number, sign and return the form to Oldham MBC.
Note 4 (Question 4) Please note that some policy and site references, titles and names in the First Deposit UDP
have been changed for the Revised Deposit UDP. When providing details of the proposed change you are
commenting on, please use the policy reference and title, paragraph number, site reference and name, or map
change reference (whichever is applicable) contained within the Revised Deposit UDP. (Please use a separate form
for each proposed change you wish to comment on). Do not use the policy and site references in the First
Deposit UDP, unless it is a policy or site that has been deleted.Note 5 (Question 5) If your comment does relate to an objection that you made to the First Deposit UDP during
autumn 2001, please answer YES and go to Question 6. If your comment does not relate to a previous objection,
please answer NO and go to Question 7.
Note 6 (Question 6) If you answered YES to question 5, please indicate whether the proposed change in the
Revised Deposit UDP fully satisfies your original objection, i.e. you support the proposed change and wish to
conditionally withdraw your objection subject to the proposed change being adopted (please sign and return the
form to Oldham MBC), OR it partially satisfies your original objection OR it does not satisfy your original objection
at all and you wish also to object to the proposed change. Please only tick one response to this question. If
the proposed change only partially satisfies your original objection, please explain your reasons in questions 8
and 9.
Note 7 (Question 7) If you answered NO to question 5, please indicate whether you are objecting to, or
supporting, a proposed change in the Revised Deposit UDP.
Please indicate the reasons for your objection to, or support for, the proposed change in question 8, and for
objections please indicate how you wish the UDP to be changed in question 9.
Note 8 (Question 8) Please indicate here the reasons for your objection to, or support for, a proposed change
in the Revised Deposit UDP. Use a separate sheet if necessary and attach it to your comment form.
Note 9 (Question 9) If objecting to a proposed change in the Revised Deposit UDP, please indicate how you
wish the Plan to be changed. Use a separate sheet if necessary and attach it to your comment form.
Note 10 (Question 10) This part of the comment form is for those who are objecting to the proposed changes
in the Revised Deposit UDP. If there is a Public Local Inquiry to resolve outstanding objections to the UDP, please
indicate whether you wish to provide your evidence in writing to the independent Inspector or if you wish to
appear at the Inquiry. If there are other objectors beside yourself to the same part of the UDP, please indicate
whether you are willing to present a joint case to the Inquiry.
WHAT HAPPENS NEXT
The Council will acknowledge comments received and consider whether further changes to the UDP should be
proposed in response. All remaining objections to both the First Deposit UDP, and those to the Revised Deposit
UDP that the Council are unable to satisfy, will be considered by an independent Inspector at a Public Local Inquiry.
This is likely to be held in mid-to-late 2004. Objectors will be notified of the precise arrangements for the Inquiry
when they are finalised. Adoption of the Replacement UDP is scheduled for 2005
