La nouvelle loi allemande à l'égard les étrangers a été mise en vigueur le 1er janvier 1991. L'accent a été mis sur les modifications intervenues par rapport à la loi de 1965 en comparant à la situation juridique des étrangers en France. Deux changements d'attitude ont été constatés, l'introduction d'un droit au séjour et de la naturalisation dite «facilitée ». Cette dernière, uniquement accessible aux jeunes étrangers et à des étrangers résidant depuis longtemps en Allemagne, quitte enfin l'orientation exclusivement ethnique (völkisch) du droit de la nationalité allemande.
En revanche, et ceci malgré le droit au séjour, la nouvelle loi maintient la conception de la consolidation progressive du statut de séjour et introduit des dispositions permettant de contrôler l'intégration économique, sociale et politique des étrangers.
L'harmonisation européenne et la sédentarisation des étrangers dans le pays a contraint la R.F.A à adopter une politique qui est semblable à celle des autres pays européens, mais elle propose une solution allemande préservant l'essentiel des principes antérieurs.
The new German law on foreigners' residency: change and continuity

This article about the new German law on foreigners which came in force on 1-1-91, emphasizes the changes made to the 1965 law and the differences between the situations of foreigners in France and Germany. Two changes of attitude are to be noted: the introduction of a right of residence and of an « earlier » naturalisation. This naturalisation which is limited to young foreigners and foreigners who have been living in Germany for a long time, finally gets away from the principles of racial (völkisch) tendancies, which privileges the belonging to the socio-cultural German Community.
On the other hand, despite the right of residence, the new law continues with the idea of progressive levels of residency and introduces certain dispositions which allow the verification of the social, economic and political integration of the foreigners. European integration and the settling of foreigners have forced the German Federal Republic to adopt a policy similar to that of other European countries, but she still puts forward a German solution which maintains the main points of the old principles.
Das neue deutsche Ausländerglock : Wandel und Kontinuität

In diesem Artikel über das neue deutsche Ausländergesetzes, das seit dem 1. Januar 1991 in Kraft ist, werden hauptsächlich die entscheidenden Änderungen im Verhältnis zum Gesetz von 1965 umd in Vergleich zur französischen Gesetzeslage der Ausländer vorgestellt. Die Einführung eines Aufenthaltrechtes und die erleichterte Einbürgerung sind die zwei Punkte, in denen sich die Einstellung grundsätzlich verändert hat. Die erleichterte Einbürgerun, die jedoch nur jugentlichen Ausländern und Ausländern mit langem Aufenthalt zugänglich ist, wendet sich erstmals von der ausschliesslich völkischen Ausrichtung des deutschen Staastsangehörig keitsgesetzes ab. Allerdings behält das neue Gesetz, trotz des Rechts auf Aufenthalt, dasPrinzip des sich nach und nach verfestigenden Aufenthaltsstatus bei. Weiterhin sind in diesem Zusammenhang Regeln eingeführt worden, die ist ermöglichen die wirtschaftliche, soziale und politische Integration der Ausländer zu überprüfen.
Die Gesetzesnivellierung der europäischen Gemeinschaft zum einen und die Niederlassung der Ausländer zum anderen haben die Bundesrepublik mehr oder weniger gezwungen, eine den anderen europäischen Ländern ähnliche Politik zu betreiben. Sie schlägt jedoch eine deutsche Lösung vor, die den Grobteil der früheren Prinzipen beibehält.
